Two areas people get wrong in both directions

These two get banned wholesale or opened wholesale, and both are wrong. The line runs through identity and conduct, not industry.

Legal work

  • ❌Referring cases to lawyers and taking a cut of the feeLawyers Law Art. 26 bars law firms and lawyers from soliciting work by paying referral fees; Art. 25 requires the firm to accept the engagement and collect the fee. A cut on closing means the lawyer pays us a referral fee, and our collecting the money breaks the unified-collection rule — both are statute, not regulation.
  • ❌Appearing in court, acting as defence counsel, or taking part in a proceeding for a partyLawyers Law Art. 13 bars anyone without a practising certificate from acting as litigation representative or defence counsel; Civil Procedure Law Art. 61 limits representatives to lawyers, grassroots legal workers, close relatives or employees of the party, and citizens recommended by their community, employer or a relevant association — a stranger from a platform cannot enter that list.
  • ❌Issuing legal opinions, promising a win or a filing outcome, contingency feesRequires a practising licence; promising outcomes separately breaches the Advertising Law and is a focus of the crackdown.
  • ✅Drafting a complaint, appeal or defence for the party to sign and file themselvesLawyers Law Art. 13 bars exactly two things — using the title of lawyer, and acting as representative or counsel. A draft the party signs and files themselves touches neither: the writer’s name never appears and they never stand in. This is the lawful business of legal consulting firms.
  • ✅Contract review, flagging risky clauses, suggesting alternative wording (unsigned, no representation)Same reasoning: no title, no representation — ordinary document and information work.

Counterintuitive but important: a non-lawyer may draft a complaint; a practising lawyer may not take that job here. Lawyers Law Art. 28 lists drafting litigation documents as lawyers’ business, and once it is lawyers’ business Art. 25 requires the firm to accept the engagement and collect the fee — a lawyer taking the job and the money personally is accepting an engagement privately.

Finding people

The line isn’t about whether you’re finding people — it’s whether you step into the hiring decision. There is no job-seeker side here; what’s delivered is information, and what’s paid is a fixed fee for that information.

Banned by conduct, not by industry. Each one states its basis — statute, policy, or simply something we can’t stand behind. Those three must not be conflated.

Impersonating a licensed professional, or standing in for someone

Promising outcomes you don’t control

  • · Contingency fees based on the amount at stake or on winning — note this is not the same as paying on delivery: a headhunter-style “paid when one is signed” has a concrete, checkable deliverable (a signed agreement) and is allowed

  • · Investment guarantees, insurance sales, loan brokering (require financial licences)
  • · Funeral services, nursing care, pharmaceutical delivery
  • · Freight or hazardous-goods transport requiring a road transport permit
